Addressing Gaps in Tobacco Regulation

The Family Smoking Prevention and Tobacco Control Act of 2009 (Tobacco Control Act) gave the U.S. Food and Drug Administration (FDA) the authority to regulate all tobacco products. However, in its charge to the FDA, Congress only required the FDA to regulate cigarettes, cigarette tobacco, smokeless tobacco and roll-your-own tobacco. The Act allows the FDA to regulate all other tobacco products, but to do so the agency has to take an affirmative step to assert jurisdiction over those products. In the four years since the passage of the Tobacco Control Act, the FDA has repeatedly announced that it plans to regulate other products, but so far that talk has not translated into any action.
